These are the terms and conditions for SPU's Outdoor Recreation Program. To create an account, you must agree to our conditions regarding damage fees and late returns. You will not be able to reserve gear if you do not accept these terms. Please specify YES you accept the terms and conditions and sign electronically using your name as entered above. FEES and FINES
Late Fees - All equipment is due the date specified on the Rental Agreement Form, and must be checked into the Outdoor Recreation Coordinator’s (ORC) office in the SUB on the scheduled date. Any equipment returned after the due date will incur a late fee of $5 for each renter. Each 24 hour day following the due date for which the equipment is unreturned, will incur an additional five ($5) dollar late fee. If the equipment is not returned on the due date + 10 days, the maximum late fee of the replacement expense is assessed. The maximum late fee assessed will be the replacement expense price of the equipment or $20, whichever is greater.
Damage Fines - A damage fine will be assessed if equipment is returned in a manner requiring repairs or replacement of equipment. A damage fine is only assessed once after an evaluation is completed by the Outdoor Recreation Coordinator. The amount of the fine is at the discretion of the ORC and is not to exceed the replacement value of the equipment.
Cleaning Fee - A cleaning fee of ten ($10) dollars will be assessed should the equipment be returned needing to be cleaned or dried before returning it to a rentable status. This fee is assessed at the discretion of the ORC.
Lost or Stolen Equipment - All renters assume responsibility for the safety and security of the equipment they are renting. Renters will be held liable for the replacement cost of the equipment, whether or not the loss is due to the fault of the renter.
Student Account Holds
Renters who are delinquent in the payment of assessed fees and fines at 10 days past due, will be reported to the Student Financial Services office and will be subject to SPU’s Unpaid Student Charges policy which can be found online in the SPU Undergraduate and Graduate Student Catalogs under Costs and Financial Aid, sub-section Financial Arrangements and Services. Unpaid fees and fines will prevent students from registering for future courses and accessing official transcripts until such financial obligations have been settled. All payments must be made to the ORC’s office.
To Lift Student Account Holds – Pay the delinquent fees and fines in full to the ORC. Once paid, the hold will be cleared and taken off the Student’s Account within five (5) business days.
Release of Claims
By signing below, I acknowledge that I understand that the use of the recreational, outdoor rental equipment involves risk, including the risk of injuries, illnesses, and even death, and in consideration for being able to use the equipment provided through SPU and ASSP’s Outdoor Recreation Program, I assume these risks. I further acknowledge that SPU is not responsible for evaluating, knowing, or verifying the renter’s or any equipment users’ skill, knowledge, and/or ability to conduct the outdoor recreational activity for which I am renting equipment. All activities are done at the renter’s own risk, ability, and discretion. I release, forever discharge, and agree not to sue SPU, its board of trustees, administrators, employees or students and hereby waive all claims arising out of or in any way connected to my use of the equipment provided through this Rental Agreement Form. Further, I shall indemnify, defend and hold harmless SPU, its board of trustees, administrators, employees, and students from any claims, damages, losses, and judgments resulting either directly or indirectly from my rental and/or use of this equipment. I agree that this assumption of risk and release of liability agreement shall bind my heirs and my estate. Additionally, I accept full responsibility, including, but not limited to, general, physical and financial liability for the rental equipment and the activities I conduct while subject to the terms of this agreement.
Therefore, if any of the equipment is lost, damaged, late or unclean I agree to:
Pay for repairing or replacing the equipment.Pay the cost of additional cleaning and drying if the equipment is excessively dirty or wet when I return it.Pay a late fee if I return the equipment after the scheduled return date and time.
In consideration for the use of the Outdoor Recreation Program services and equipment rental, and by signing below, I acknowledge and agree that I am aware this is a release of liability, a waiver of claims, an agreement not to sue, and a contract between myself and SPU and for the benefit of all parties described herein. I sign it of my own free will.

You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. You are also consenting to be legally bound by this Agreement's terms and conditions.
